Overview
Vicky, a partner at the firm, brings with her over a decade and a half of experience in public and private enforcement of the antitrust laws, both in the context of mergers and anticompetitive conduct.
Prior to joining Simonsen Sussman, Vicky served at the Federal Trade Commission in the Mergers II division of the Bureau of Competition, investigating and litigating mergers in various sectors, including consumer products, technology, chemicals, and glass. In 2024, Vicky was part of the trial team that successfully litigated the FTC’s challenge to the Tapestry-Capri merger and obtained a preliminary injunction in the Southern District of New York blocking the transaction.
Prior to the FTC, Vicky was a partner at a plaintiff-side law firm, litigating Sherman Act § 1 and § 2 cases on behalf of small businesses. Vicky recovered hundreds of millions of dollars for class members in complex litigation around the country. In Fusion Elite All Stars, et al. v. Varsity Brands, LLC, et al., 20-cv-02600, Vicky, as Co-Lead Counsel, represented gyms who were harmed by a monopolistic scheme in the all-star cheer competition market. The case resolved for $43.5 million, as well as significant prospective relief. Vicky was honored by the American Antitrust Institute for her work on the case with an Outstanding Antitrust Litigation Achievement in Private Enforcement award.
As Interim Co-Lead Counsel in the Hard Disk Drive Suspension Assemblies Antitrust Litigation, 19-md-02918, Vicky represented indirect purchasers of hard drive suspension assemblies—critical components of hard drives found in computers, servers and other forms of digital storage—who were victims of a more-than-decade-long price-fixing conspiracy. Vicky prevailed on the motion to dismiss as well as the motion for class certification.
Vicky was also the lead attorney on day-to-day discovery and dispositive issues for the Dealership Class in the Automotive Parts Antitrust Litigation, 12-md-02311, where she won the majority of contested motions before the court and the special master. The case involved two decades of price-fixing and bid-rigging conduct, 70 defendant families, and 42 automotive parts. Vicky was honored with the American Antitrust Institute’s Outstanding Litigation Achievement by a Junior Lawyer award for her work in that case, which resolved with a $400 million recovery for the class.
Vicky also represented pharmacists against generic drug manufacturers in the Generic Pharmaceuticals Pricing Antitrust Litigation.
In addition, Vicky previously served as the Chair of the Amicus Committee of the Committee to Support the Antitrust Laws (“COSAL”), an industry group devoted to the maintenance and enforcement of the antitrust laws. As the Committee Chair, she oversaw the filing of amicus briefs in U.S. courts of appeal, as well as the U.S. Supreme Court, in support of the D.C. Attorney General, a competitor to Apple’s App store, and several minor league baseball teams.
Vicky graduated from Brandeis University and received her J.D. from the Catholic University Columbus School of Law.
